Most court cases begin when one of the parties files a complaint, motion, or other legal documents with the clerk of the court. Typically, the party that initiates a lawsuit is referred to as the "plaintiff" or "applicant" and the party against whom the suit is brought is referred to as the "defendant" or "defendant." Once you have submitted the paperwork, the other party must be "served" with the paperwork; this is also known as "process maintenance". The person you are filing a claim against will receive a subpoena or notice of petition (a formal notice of appearance) and copies of the documents you filed, which usually include the petition and affidavit. This will notify the other party of the actual court case and any scheduled court dates. In some cases, the clerk of the court may arrange for service, and in other cases, the plaintiff must arrange for service on the other side.
