The Senate is composed of deputies elected on two persons from each oblast, city of Republican significance and the capital of the Republic of Kazakhstan at the joint session of deputies of all representative bodies of the respectively oblast, city of Republican significance and the capital of the Republic. Fifteen deputies are appointed by the President of the Republic taking into account necessity of maintenance of representation for the Senate of national-cultural and other significant interests of society. Half of the elected deputies of the Senate are elected every three years. The term of office of the Senate deputies is six years.

The division is headed by a Chairman, elected by the Senate from among the deputies with a fluent speaking state language, by secret ballot by a majority of votes from total number of deputies of Chamber. Candidate for the position of President of the Senate is nominated by the President of the Republic of Kazakhstan.According to the Constitution of the Republic of Kazakhstan, adopted on Republican referendum on 30 August 1995, the bicameral Parliament of the Republic of Kazakhstan is the Supreme representative body of the Republic performing legislative functions. The organization and activities of Parliament of the Republic of Kazakhstan, legal position of its deputies are determined by the Constitution, Constitutional Law "On Parliament of the Republic of Kazakhstan and status of its deputies" and other legislative acts. The authorities of the Parliament begin from the moment of opening its first session and end with the beginning of the first session of the new Parliament. The term of office of Parliament is determined by the term of powers of deputies of the Mazhilis of the next convocation. Early termination of powers of Parliament may be carried out only in cases and order stipulated by the Constitution of the Republic of Kazakhstan.

The Parliament consists of two Chambers: Senate and Mazhilis acting on a constant basis.
